1. INTRODUCTION
Neon Lobster LLC, a Florida limited liability company ("Company," "we," "us," or "our"), operates the UltraClaw AI agent platform and the website at ultraclaw.ai (collectively, the "Service"). This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use the Service.
By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of Service. This Privacy Policy should be read in conjunction with our Cookie Policy, which describes how we use cookies and similar technologies. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.
2. INFORMATION WE COLLECT
2.1 Information You Provide
(a) Account Information. When you create an account, we collect your mobile phone number, which is verified via SMS. You may also provide your first name, last name, and email address during the payment process.
(b) Payment Information. When you subscribe to the Service, we collect payment information through our payment processor, Stripe, Inc. We do not directly store your full credit card number, bank account number, or other sensitive payment credentials. Stripe handles and stores payment information in accordance with PCI-DSS standards.
(c) Agent Configuration. We collect the preferences you set for your AI agent, including your chosen LLM provider, model selection, agent name, and communication channel preferences.
(d) User Content. We process the messages, instructions, files, and other content you provide to your AI agent through any supported channel (iMessage, SMS, or web chat).
(e) Communications. If you contact us for support or other inquiries, we may collect the content of those communications.
2.2 Information Collected Automatically
(a) Usage Data. We collect information about how you interact with the Service, including feature usage patterns, session duration, frequency of use, and general interaction metrics.
(b) Device and Connection Information. We may collect your IP address, browser type, operating system, device identifiers, and referring URLs when you access the Service through the web dashboard.
(c) Cookies and Local Storage. We use strictly necessary cookies for authentication and session management, and browser local storage to maintain your session preferences. (d) System Performance Data. We collect technical logs and performance metrics from the Service infrastructure, including error rates, response times, API call volumes, and resource utilization.
(e) Billing and Credit Usage. We track your token consumption, credit balance, billing transactions, and subscription status.
2.3 Information from Third Parties
(a) Payment Processor. Stripe may provide us with limited payment information, such as billing name, billing email, payment method type, and the last four digits of your card number.
(b) Messaging Providers. Our messaging infrastructure providers (including Twilio for SMS and urelay for iMessage) may provide us with message delivery status, timestamps, and routing information.
3. HOW WE USE YOUR INFORMATION
We use the information we collect for the following purposes:
(a) Providing the Service. To create and maintain your account, provision and operate your dedicated AI agent instance, process your messages, and deliver the core functionality of the Service.
(b) Payment Processing. To process subscription payments, manage billing cycles, track credit balances, and handle refunds.
(c) Service Improvement and Quality Monitoring. We may monitor, collect, and analyze aggregated and anonymized usage data, system performance metrics, and Service interaction patterns to improve the quality, reliability, functionality, and user experience of the Service. This may include analyzing feature usage trends, identifying and resolving technical issues, optimizing system performance, and developing new features.
(d) Communication. To send you service-related notices, billing confirmations, security alerts, and support responses. We may also send you information about Service updates or changes.
(e) Security and Fraud Prevention. To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
(f) Legal Compliance. To comply with applicable laws, regulations, legal processes, or governmental requests.
(g) Enforcement. To enforce our Terms of Service and Acceptable Use Policy.
4. HOW WE SHARE YOUR INFORMATION
4.1 We Do Not Sell Your Data
The Company does not sell, rent, lease, or trade your personal information, User Content, conversation data, or AI Output to any third party under any circumstances.
4.2 Third-Party Service Providers
We share information with third-party service providers who assist us in operating the Service. These providers process your information solely on our behalf and in accordance with our instructions. Our key service providers include:
(a) LLM Providers (Anthropic, OpenAI, Google). Any data you provide to the Service, including messages, prompts, files, and other content, may be transmitted to these third-party AI model providers as necessary to generate AI responses and deliver the Service. Once transmitted to a third-party LLM provider, the handling, storage, and processing of such data is governed by that provider's own terms of service and privacy policies and is outside the Company's control. We encourage you to review the privacy policies of these providers:
(b) Stripe (Payment Processing). We share billing and payment information with Stripe to process transactions. See the Stripe Privacy Policy.
(c) Hetzner Cloud (Infrastructure). Your dedicated agent instance is hosted on Hetzner Cloud infrastructure in the European Union. See the Hetzner Privacy Policy.
(d) Twilio (SMS). If you use the SMS channel, message content and phone numbers are transmitted through Twilio's infrastructure. See the Twilio Privacy Policy.
(e) urelay (iMessage). If you use the iMessage channel, message content and phone numbers are transmitted through urelay's infrastructure.
4.3 Legal Requirements
We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that such disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend the rights or property of the Company; (c) prevent or investigate possible wrongdoing in connection with the Service; (d) protect the personal safety of users or the public; or (e) protect against legal liability.
4.4 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of the Company's assets, your personal information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Site before your information becomes subject to a different privacy policy.
4.5 With Your Consent
We may share your information for any other purpose with your explicit consent.
5. DATA STORAGE AND SECURITY
5.1 Data Location
Your dedicated agent instance is hosted on Hetzner Cloud infrastructure located in the European Union (Germany and Finland). Account and billing data is stored on servers operated by the Company within the same infrastructure.
5.2 Instance Isolation
Each User's AI agent operates on a dedicated, isolated virtual machine. Your computing environment is not shared with other users.
5.3 Security Measures
We implement reasonable technical and organizational measures to protect your personal information, including:
(a) Encrypted communications (TLS/SSL) for all data in transit; (b) JWT-based authentication for API access; (c) Isolated virtual machines per customer; (d) Access controls limiting employee access to customer data; (e) Regular security monitoring and incident response procedures.
However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your information, we cannot guarantee its absolute security.
5.4 Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. Upon account termination:
(a) All data on your dedicated instance (including files, agent memory, conversation history, and configurations) is permanently and irrecoverably destroyed; (b) Account records (phone number, name, email) and billing records (transaction history, subscription details) may be retained for up to three (3) years after account termination for legal compliance, tax obligations, and dispute resolution purposes; (c) Aggregated, anonymized data that cannot be used to identify you may be retained indefinitely for analytics and Service improvement purposes.
6. YOUR RIGHTS AND CHOICES
6.1 Access and Correction
You may access and update your account information through the Service dashboard or by contacting us at support@ultraclaw.ai.
6.2 Account Deletion
You may delete your account at any time by cancelling your subscription. Upon cancellation, your dedicated instance and all associated data will be permanently destroyed as described in our Terms of Service.
6.3 Communication Preferences
You may opt out of non-essential communications by contacting support. You cannot opt out of essential service-related communications (e.g., billing notices, security alerts, Terms of Service updates) while maintaining an active account.
6.4 Data Portability
You may request a copy of the personal data we hold about you (account information and billing records) by contacting us at support@ultraclaw.ai. Please note that conversation data and files stored on your dedicated instance are accessible directly through your agent and web dashboard while your account is active.
6.5 Do Not Track
The Service does not currently respond to "Do Not Track" browser signals.
7. CALIFORNIA PRIVACY RIGHTS
If you are a California resident, you may have additional rights under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA"), including:
(a) Right to Know. You have the right to request information about the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share your information.
(b) Right to Delete. You have the right to request deletion of your personal information, subject to certain exceptions.
(c) Right to Opt-Out of Sale. We do not sell your personal information. As such, we do not offer an opt-out for the sale of personal information.
(d) Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.

8. CHILDREN'S PRIVACY
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to promptly delete such information. If you believe we have collected information from a child under 18, please contact us immediately at support@ultraclaw.ai.
9. INTERNATIONAL DATA TRANSFERS
The Service is operated from infrastructure located in the European Union and the United States. If you access the Service from outside these regions, you understand and consent to the transfer, storage, and processing of your information in these locations. We will take reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy.
10. THIRD-PARTY LINKS AND SERVICES
The Service or AI agent may reference, link to, or interact with third-party websites, services, or content. We are not responsible for the privacy practices or content of these third parties. We encourage you to review the privacy policies of any third-party services you interact with.
11. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. Material changes will be communicated via email or prominent notice on the Site at least thirty (30) days before they take effect. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated Privacy Policy. The "Last Updated" date at the top of this Policy indicates when the most recent revisions were made.
